1. INTRODUCTION

1.1 Promotion Name & Organizer

The “iPhone 16 Pro Giveaway” (the “Promotion”) is organized by Avas Enterprises Pvt Ltd (“Avas Enterprises,” “we,” “our,” or “us”) and offers participants the chance to win an iPhone 16 Pro (the “Prize”) through a monthly lucky draw.

1.2 No Affiliation with Apple
This Promotion is an independent event organized by Avas Enterprises and is not affiliated with Apple Inc. in any way.

1.3 Acceptance of Terms
By participating in this Promotion, participants confirm that they have read, understood, and agree to be bound by these terms and conditions (“Terms”), including any updates or modifications.

1.4 Definitions

  • “Participation”
    The act of booking and completing (or driving) an eligible ride within our app, which automatically provides an entry into the monthly lucky draw.

  • “Completed Ride”
    A ride that:

    1. Begins at the designated pick-up location and ends at the designated drop-off location,

    2. Is fully tracked and completed through our app,

    3. Is fully paid for (if applicable), and

    4. Is not canceled or reversed.

  • “Legitimate Ride”
    A ride that is not fraudulent, artificially inflated, or in violation of these Terms, and adheres to all applicable laws and app policies.

  • “Incomplete Ride”
    A ride that is canceled, not completed as per the app process, or does not meet the criteria of a “Completed Ride.”

2. PROMOTION PERIOD

2.1 Start & End Dates
The Promotion begins on 10 January 2025 and continues monthly until 10 July 2025. (the “Promotion Period”)

2.2 Monthly Cutoff
Each month’s eligible entries will be counted from 00:00 on the first day of the month until 23:59 on the last day of the month.

2.3 Right to Modify
Avas Enterprises reserves the right to modify or extend the Promotion Period at its sole discretion. Any changes will be published on our official website or app.

3. ELIGIBILITY

3.1 Who Can Participate

  • Individuals aged 18 years or older on or before the start of the Promotion.

  • Must be a visa holder or resident of the Maldives.

  • Must have a valid, active account on our ride-booking app continuously (as a driver or a customer) throughout the Promotion Period.

3.2 Participation Requirement

  • Each completed, legitimate ride through our app during the Promotion Period automatically provides one (1) entry into the monthly lucky draw.

  • Both drivers and customers are eligible to participate.

  • More rides equal more entries, increasing the chances of winning.

  • Any ride that is determined to be fraudulent, artificially inflated, incomplete or in violation of these Terms will not be counted.

3.3 Exclusions

  • Employees of Avas Enterprises and their immediate family members.

  • Anyone who does not meet the criteria stated in these Terms.

  • Anyone under the age of 18 as of the Start date of the Promotion.

3.4 Booking Rides for Others
Bookings made on behalf of someone else do not qualify unless you are physically the passenger or the driver completing the ride.

4. REGISTRATION & ENTRY PROCESS

4.1 Automatic Entry
No separate registration is required. Each eligible Completed Ride during the Promotion Period grants one (1) entry. There is no limit to the number of rides (entries) accumulated within a month.

4.2 Validity of Rides

  • A ride must be a Completed Ride to count as an entry.

  • Incomplete Rides or canceled rides are not eligible.

  • Avas Enterprises reserves the right to investigate and disqualify rides suspected of being non-Legitimate or fraudulent.

4.3 Monitoring & Verification
We use internal app data, including but not limited to ride logs, payment confirmations, driver and passenger IDs, and location tracking, to verify the authenticity of each ride. Avas Enterprises reserves the right to disqualify suspicious rides and/or participants that fail verification checks.

4.3 Monthly Reset
Entries reset at the beginning of each month. Rides completed in a prior month do not count toward the subsequent monthly draws.

4.4 Multiple Entries
Participants can accumulate multiple entries based on the number of completed rides during the relevant month.

5. THE PRIZE

5.1 Monthly Prize
One (1) iPhone 16 Pro will be awarded each month via a lucky draw, with one (1) winner selected from drivers and one (1) winner selected from customers.

5.2 Prize Specifications
The Prize is an iPhone 16 Pro (128GB, Any Color). Exact specifications and features will be based on Apple’s current model at the time of the draw.

5.3 No Cash Substitution
No cash or other substitution is permitted unless the Prize becomes unavailable for any reason, in which case Avas Enterprises reserves the right to provide an equivalent replacement.

5.4 Prize Transferability
The Prize is non-transferable by default. However, after taking possession, the winner may transfer or sell the Prize at their discretion.

6. MONTHLY DRAW PROCESS

6.1 Draw Date
The monthly lucky draw will be conducted on or about the 10th day of the following month (e.g., the draw for January entries will occur on or about 10th February 2025). Avas Enterprise may amend the date of the month without prior notice.

6.2 Fairness & Transparency
The draw will be conducted using a randomized digital raffle system to ensure fairness and transparency. An external party may supervise the process.

6.3 Separate Draws for Drivers and Customers
Two winners will be selected each month:

  1. One (1) winner from the pool of drivers.

  2. One (1) winner from the pool of customers.

7. WINNER NOTIFICATION & PRIZE COLLECTION

7.1 Notification
Winners will be contacted via phone call, email, or their registered app profile details within three (3) working days after the draw. Additionally, the names of the winners may be published on Avas’ official social media platforms, including but not limited to Facebook, Instagram, and Twitter, as part of the announcement.

7.2 Verification
Winners must provide a valid government-issued ID (e.g., National ID, Passport, Visa ID) to claim the Prize.

7.3 Claim Period

  • Winners must claim the Prize within thirty (30) days from the date of the first notification.

  • If a winner fails to respond or claim the Prize within thirty (30) days , Avas Enterprises reserves the right to forfeit the Prize without the need to provide any compensation and either conduct a new draw or select an alternate winner. Acceptance of the Prize shall be deemed completed upon collection of the Prize by the Winner.

7.4 Prize Handover
The Prize handover will be conducted in Malé City at a date, time, and location determined by Avas Enterprises.

8. GENERAL TERMS

8.1 Disqualification
Avas Enterprises reserves the right to disqualify any participant who is found to have violated these Terms, engaged in fraudulent activity, or attempted to manipulate ride counts or entries.

8.2 Governing Law
Any disputes arising from this Promotion will be governed by the laws of the Republic of Maldives.

8.3 Amendments
Avas Enterprises reserves the right to amend or update these Terms at any time. Any changes will be published on our official website or app.

8.4 Organizer’s Liability
Avas Enterprises shall not be liable for any technical or human error in connection with the Promotion, nor for any damage, loss, or injury resulting from participation or the use of the Prize.

8.5 Dispute Resolution:

Any disputes, disagreements, or claims arising out of or relating to this Promotion, including its terms, conditions, or interpretation (the “Claims”), shall be exclusively submitted to the DAvocats Chambers LLP (the “Adjudicator”). The decision of the Adjudicator shall be final, binding, and conclusive on all parties. No dispute or claim shall be submitted to any other court of law or judicial or non-judicial authority. By participating in the Promotion, participants expressly waive their right to pursue legal action in any forum outside the Adjudicator.

All claims must be submitted in writing to the Adjudicator within 30 days of the event, giving rise to the dispute, failing to which the claim shall be deemed waived and barred. The contact information of the Adjudicator is stated below:
