1. INTRODUCTION
1.1. The “Car Giveaway” (the “Promotion”) is organized by Avas Enterprises Pvt Ltd (“Avas Enterprises,” “we,” “our,” or “us”) and offers participants the chance to win a brand-new Nissan E Power Aura 2023 (the “Prize”). This Promotion is an independent event by Avas Enterprises and is in no way endorsed by or affiliated with Nissan or any other brand.
1.2. By participating in this Promotion, participants confirm that they have read, understood, and agree to be bound by these terms and conditions, as well as any updates or modifications (“Terms”).
2. DEFINITIONS
2.1. In this Agreement:
“Agreement” refers to: a) These Terms; and
b) Any referenced policies or guidelines by Avas Enterprises.
“Avas Enterprises” means Avas Enterprises Pvt Ltd with a registered address at Lot 11217, Hulhumalé, Republic of Maldives, and “we,” “our,” or “us” also refer to Avas Enterprises.
“You,” “Your,” or “participant” means any person who books or completes a ride through our app and meets the eligibility criteria set out in Clause 4.
“Promotion Period” is defined in Clause 5.
“Draw Date” means the date on which a winner of the Prize is chosen.
“Mega Prize” means the Nissan E Power Aura 2023 (Black Color) car.
“Participation”
The act of booking and completing (or driving) an eligible ride within our app, which automatically provides an entry into the monthly lucky draw.
“Completed Ride”
A ride that:
Begins at the designated pick-up location and ends at the designated drop-off location,
Is fully tracked and completed through our app,
Is fully paid for (if applicable), and
Is not canceled or reversed.
“Legitimate Ride”
A ride that is not fraudulent, artificially inflated, or in violation of these Terms, and adheres to all applicable laws and app policies.
“Incomplete Ride”
A ride that is canceled, not completed as per the app process, or does not meet the criteria of a “Completed Ride.”
3. ORGANIZER DETAILS
3.1. Organizer: Avas Enterprises Pvt Ltd.
3.2. Registered Address: Lot 11217, Hulhumalé, Republic of Maldives.
3.3. Co-sponsors/Partners: None.
4. AGREEMENT TO TERMS
4.1. By completing a ride through our app and thereby entering the Promotion, You confirm Your acceptance of these Terms.
4.2. If You do not agree to these Terms, please do not participate in this Promotion.
5. PROMOTION PERIOD
5.1. The Promotion begins on 10 January 2025 and continues for six (6) months, ending on 10 July 2025 at 23:59 (“Deadline”).
5.2. No entries will be accepted after 23:59 on the Deadline.
5.3. Avas Enterprises reserves the right to modify or extend the Promotion Period at its sole discretion. Any changes will be published on our official website or app.
6. ELIGIBILITY
6.1. Who Can Participate:
Individuals aged 18 years or older on or before the start of the Promotion.
Must be a visa holder resident of the Maldives.
Must have a valid, active account on our ride-booking app continuously throughout the Promotion Period. (either as a driver or a customer).
6.2. Participation Requirement:
Each time You complete a ride through our app within the Promotion Period, You automatically receive one (1) entry into the Promotion.
Both drivers and customers earn entries for each completed ride.
For the purpose of this section, a "completed ride" refers to a ride that has been successfully requested, accepted, and finished by the driver, with the passenger reaching their intended destination. Only rides that meet all platform guidelines and are not flagged for fraud, cancellation, or disputes will be considered in determining the highest number of completed rides.
6.3. Exclusions:
Employees of Avas Enterprises and their immediate family members.
Anyone who does not meet the criteria stated in these Terms.
Anyone under the age of 18 as of the Start of the Promotion.
6.4. Booking Rides for Others: Bookings made on behalf of someone else do not qualify unless You are physically the passenger or the driver completing the ride.
7. REGISTRATION & ENTRY PROCESS
7.1. Automatic Entry: No separate registration is required. Each completed ride during the Promotion Period grants You one (1) entry. There is no limit to the number of entries (i.e., rides) You can accumulate.
7.2. Validity of Rides: A ride must be fully completed and paid for (if applicable) to count as an entry. Cancelled or incomplete rides are not eligible.
8. THE PRIZE
8.1. Mega Prize: One (1) unit of Nissan E Power Aura 2023 (Black Color).
The Prize is unregistered. Avas Enterprises will help the winner with the registration process, provided that the registration shall complete within six months from the date of winning the prize.
All costs related to registration, insurance, road tax, or any additional fees are the sole responsibility of the winner.
The winner at its own cost shall find a garage to register the vehicle.
No cash or other substitution is allowed if the car becomes unavailable for any reason.
8.2. Prize Transferability: The Prize is non-transferable by default. However, after taking ownership, the winner may choose to sell or otherwise transfer the Prize at their own discretion.
8.3. No Additional Accessories or Warranties: No additional accessories or extended warranties are offered beyond what comes standard from the manufacturer.
8.4. Prize “As-Is”: Prizes are awarded “as-is,” without warranties of any kind, express or implied, by Avas Enterprises.
9. DRAW PROCESS
9.1. Mega Prize Draw:
The Mega Prize draw will take place after six (6) months from the Launch Date, on or about 10 July 2025 (the “Draw Date”), by a random raffle selection that may be broadcast live. Avas Enterprise may amend the date of the month without prior notice.
All eligible entries (drivers and customers combined) will be included in the Mega Prize draw.
10. WINNER NOTIFICATION & PRIZE COLLECTION
10.1. Notification: Winners will be contacted via phone call, email, or their registered app profile details within three (3) working days after the draw. Additionally, the names of the winners may be published on Avas’ official social media platforms, including but not limited to Facebook, Instagram, and Twitter, as part of the announcement.
10.2. Verification: Winners must provide a valid government-issued ID (e.g., National ID, Passport) to claim the Prize.
10.3. Claim Period:
Winners must claim the Prize within one (1) month from the date of first notification.
If the winner fails to respond or claim the Prize within one (1) month, Avas Enterprises reserves the right to forfeit the Prize without the need to provide any compensation. and either conduct a new draw or select an alternate winner. Acceptance of the Prize shall be deemed completed upon collection of the Prize by the Winner.
10.4. Prize Handover: The Mega Prize handover will be conducted in Malé City at a date, time, and location determined by Avas Enterprises.
11. GENERAL TERMS
11.1 Disqualification
Avas Enterprises reserves the right to disqualify any participant who is found to have violated these Terms, engaged in fraudulent activity, or attempted to manipulate ride counts or entries.
11.2 Governing Law
Any disputes arising from this Promotion will be governed by the laws of the Republic of Maldives.
11.3 Amendments
Avas Enterprises reserves the right to amend or update these Terms at any time. Any changes will be published on our official website or app.
11.4 Organizer’s Liability
Avas Enterprises shall not be liable for any technical or human error in connection with the Promotion, nor for any damage, loss, or injury resulting from participation or the use of the Prize.
11.5 Dispute Resolution:
Any disputes, disagreements, or claims arising out of or relating to this Promotion, including its terms, conditions, or interpretation (the “Claims”), shall be exclusively submitted to the DAvocats Chambers LLP (the “Adjudicator”). The decision of the Adjudicator shall be final, binding, and conclusive on all parties. No dispute or claim shall be submitted to any other court of law or judicial or non-judicial authority. By participating in the Promotion, participants expressly waive their right to pursue legal action in any forum outside the Adjudicator.
All claims must be submitted in writing to the Adjudicator within 30 days of the event, giving rise to the dispute, failing to which the claim shall be deemed waived and barred. The contact information of the Adjudicator is stated below:
